For claims falling under Regulation (EC) No 261/2004 themselves, decree No 2025-772 of 5 August 2025 requires, for any court action brought on or after 7 February 2026, a prior referral, free of charge, to a consumer mediator before a judge can be seised (article 750-1 of the French Code of Civil Procedure): the Médiateur Tourisme et Voyage (MTV) for most airlines, or the mediator designated by the airlines affiliated with BAR France. The opinion, issued in principle within 90 days of receipt of the complete file (a period that may be extended for a complex dispute, up to 6 months), is not binding.
