We first follow up with the airline in writing. If it refuses or doesn't respond within two months, French law requires — for any court action filed from 7 February 2026 onwards (decree No. 2025-772 of 5 August 2025) — that a consumer mediator be referred to first, free of charge, before a court can be seized, on pain of inadmissibility: the Tourism and Travel Mediator (MTV) for most airlines, or the mediator appointed by BAR France for its affiliated airlines. The mediator's opinion, normally issued within 90 days of receipt of the complete file (a period that may be extended for a complex dispute, up to 6 months), is not binding but remains free for you. If court action then proves necessary, it must be brought by formal writ (via a judicial officer, typically with a lawyer): we guide you to the right mediator and spare you from having to manage this now more complex procedure alone. If court action becomes necessary, our total fee is capped at 50% incl. VAT. It covers all procedural costs (court fees, lawyer, judicial officer), which we advance and bear. If the proceedings fail, you pay nothing. Procedural costs awarded against the airline (legal costs, Article 700 of the French Code of Civil Procedure) are retained by us.
Yes. The French Civil Aviation Authority (DGAC) is the public body overseeing the application of Regulation (EC) No 261/2004 in France and lets you report a dispute (a free process, independent of individual compensation). You can also contact an accredited consumer association such as FNAUT, which holds a state-issued consumer accreditation, or consult the independent factsheets from the National Consumer Institute (INC).
On 13 July 2026, the EU Council gave final clearance to a text amending Regulations (EC) No 261/2004 and (EC) No 2027/97: improved compensation, assistance, information and re-routing, a clearer definition of "extraordinary circumstances", and new rights (no more denied boarding on a return flight for a missed outbound flight, greater price transparency on baggage fees). These rules will enter into force 12 months and 20 days after publication in the EU Official Journal — until then, the current Regulation (EC) No 261/2004 applies in full. VolClaim is tracking this and will update its calculator once the new rules take effect. Read the EU Council's press release.
